Description: Changes have been made to five aspects of the thin capitalisation rules to help strengthen the rules and better protect New Zealand's tax base. The most significant change is that the rules will now apply when non-residents who appear to be acting together own 50 percent or more of a company. Non-residents will be treated as acting together if they hold debt in a company in proportion to their equity, have entered into an arrangement setting out how to fund the company with related-party debt, or act on the instructions of another person (such as a private equity manager) in funding the company with related-party debt.
